I think the email below so mischaracterizes the history of this settlement and misstates so many facts that I cannot but offer you a general denial. I have neither the time nor the inclination to go point by point and detail the various ways in which you are getting this wrong and how your own approach has created this situation. I was not in my office, which is why I could not take your call. I will not have a check for you by two o’clock, and so I will not be visiting your office at that time. I will know if I can have the check for you this afternoon and schedule an exchange today shortly. If that is not possible, I will tell you when I will have it and perhaps we can arrange to have the exchange go forward between you and another attorney in my firm next week. Obviously, I hope this is not necessary, but, as you point out, it is only reasonable to make allowances for my absence from the office on Monday and Tuesday. You will hear from me shortly.
