6.1. Confidentiality of this Agreement. P&G may, in its discretion, divulge the existence of this agreement and the granting of the covenant not to SUE with respect to the PATENT RIGHTS to its manufacturers, potential manufacturers, customers and potential customers in connection with the manufacture or sales of PROTECTED PRODUCT. However, neither the actual terms of this agreement nor the agreement itself will otherwise be disclosed by either PARTY to any third party, without the prior written consent of the other PARTY; other than to the disclosing PARTY’S representatives and attorneys in the course of any legal proceeding to which either of the PARTIES is a party for the purpose of securing compliance with this agreement.
